Whether every SPIO is separate Public Authority?
No. PIO herself is not a public authority. Under section 5 (1) of the RTI Act, every public authority should “designate as many officers as the Central Public Information Officers or State Public Information Officers, as the case may be, in all administrative units or offices under it as may be necessary to provide information to persons requesting for the information under this Act”. PIO is supposed to obtain information from the other PIOs or any other officer within the public authority and the request cannot be transferred within the same public authority. A request can be transferred only when the information is held by another public authority or the subject matter of the information is more closely connected with the functions of another public authority. By this time, the appropriate Governments should have published a guide containing a list of public authorities.
